An inheritance file becomes easier to manage when the family agrees what must be established before anyone signs. The starting question is not simply who receives the apartment. It is which succession documents exist, who needs to participate and what information remains uncertain. A shared working file helps prevent different advisers from using incompatible assumptions.

Establish the documentary starting point

Obtain the death certificate and investigate the testamentary position. Spain’s certificate of last wills identifies whether a will was recorded and the relevant notary; it does not contain the complete testamentary instructions. The authorised will or the appropriate procedure where there is no will must therefore be considered separately.

Do not infer applicable succession rules solely from an heir’s current Barcelona address. An international history, a choice of law or property elsewhere can require additional analysis. Give the professional coordinating the succession a short factual chronology rather than a conclusion about which law you think applies.

Build a working inventory before making promises

List property, accounts, company interests, receivables and known liabilities. Record the ownership share and supporting document for each item. An asset used by the deceased is not necessarily owned entirely by that person. Keep uncertain entries visible so they can be investigated rather than disappearing from the file.

The initial document pack should include:

  • identification and evidence of relevant family relationships;
  • succession documents and any existing powers of attorney;
  • ownership records and bank information;
  • loan statements and disputed claims;
  • details of proceedings already started in another country.

As a hypothetical example, two siblings know about their mother’s home but discover an outstanding loan she made to a family business. The receivable needs examination alongside the property. Ignoring it could distort both the inventory and later discussions about distribution.

Assign the next steps

Separate confirming inheritance rights, preparing tax filings and updating ownership records. ATC’s inheritance guidance addresses the tax procedure; it should not be treated as a substitute for establishing who inherits. Agree who requests missing evidence, checks translations and maintains the current version of the inventory.

A useful first meeting ends with a list of open issues, named responsibilities and a document timetable. Avoid treating an estimate as an agreed valuation or transferring estate funds merely because all participants expect to inherit.
