Nonprofit describes the organisation's purpose and use of resources; it does not create a blanket exemption from tax. An association may receive fees, donations, grants and income from selling goods or services. Each category needs examination under the applicable rules. Start from the actual activity and the entity's legal and tax position rather than a promise that registered associations never deal with Hacienda.
Corporate income tax requires particular attention. Spanish legislation contains rules for partially exempt entities and a separate special regime for qualifying nonprofit bodies. These are not interchangeable. An ordinary association does not obtain the Law 49/2002 regime simply by registering or using public interest language. Check whether the relevant qualifying status and conditions exist before assessing eligibility or communicating benefits.
Separate that analysis from VAT, payroll withholding and other obligations arising from operations. Supplying paid training, employing staff or renting premises can create questions even where profits are retained for the association's purposes. A civil rule allowing nonprofit activities does not decide whether a particular service is VAT exempt. Review the facts and conditions applicable to each tax and transaction.
In a hypothetical example, an association supports local history and begins selling guided tours. Its committee assumes all income is exempt because proceeds buy archive materials. The intended use of surplus is relevant to the organisation's purpose, but the paid activity still needs a tax assessment. Its bookkeeping should distinguish fees, unrestricted donations and tour income so that the review uses reliable information.
Prepare statutes, registry details, activity descriptions, expected income categories, contracts, staffing plans and a budget. Check tax identification and census obligations, then identify returns and records relevant to the particular case. Do not infer an absence of filing duties merely from a small first year budget. Where an exception is considered, verify its current conditions instead of copying thresholds from an old article.
Frequent mistakes include treating invoices as donation receipts, promising donor deductions without eligibility and omitting tax from activity pricing. A simple tax obligations map should name the income or operation, applicable question and evidence needed. The national tax laws and Generalitat's association guidance address different aspects of the organisation.
