A family loan should remain understandable after the first payment. If both parties genuinely expect repayment, the agreement needs to show how the money is advanced, what is owed and how later payments reduce the balance. Trust between relatives is helpful, but it does not replace a record that everyone can follow.

Agree the economics before writing the document

Identify lender, borrower, amount and currency. Discuss the purpose and a realistic repayment arrangement. If no interest is intended, make that intention explicit rather than leaving readers to guess. The Spanish Civil Code provides the general loan framework; the appropriate document and applicable rules should be examined for the particular circumstances.

Avoid a schedule that neither party expects to use. If repayment depends on an event, explain the proposed event and obtain advice on how to express it. “Whenever possible” may describe a family conversation but does not provide a complete operating plan.

Keep the advance and repayment evidence together

Retain the signed agreement, actual transfer confirmations and later bank records. Where funding is provided in instalments, identify every advance. Give repayments a consistent reference so they are not confused with unrelated support or expense reimbursements between the same people.

ATC explains private loan and debt-recognition formalities. Any applicable exemption from a payment should not be treated as an automatic exemption from documentation or procedural requirements. Confirm the correct route for the transaction rather than copying someone else’s filing without review.

As a hypothetical case, a relative lends money for professional equipment and the borrower plans to repay from future business receipts. A workable file separates the loan from the equipment purchase and records each actual repayment. The invoice for the equipment does not by itself establish the family debt balance.

Decide how changes will be handled

Agree how the parties will record a revised date or repayment pattern. A later extension should remain connected to the original obligation. A decision to forgive part of the debt is a different event and needs its own examination rather than being recorded as though cash had been repaid.

Common problems are missing payment evidence, unexplained third-party transfers and contracts abandoned immediately after signature. Periodic balance confirmation is often more useful than a lengthy document nobody follows.
